In recent decades we have been given one of the most interesting concepts in Islamic intellectual history, `the scientific miracle of Qur’ān whereby the proponents have almost established the scientific theories in the Qur’ān. However, such ardent claims must not come to be without any inspiration and methodology. This article, firstly, tries to trace the inspiration of such concept and then describe the methodology. However, as exciting as this concept seems, the methodology brings forth a very negative approach to prove (...) the miracle of the Qur’ān, which is value free. That negative value free mentality which is related to the status of prophet of Islam will be exposed and it will detail how the status of prophet of Islam was abated so badly to prove the science from the Qur’ān. To counter this negative narrative and to reveal the true status of prophet of Islam, arguments will be presented from the Qur’ān and Ḥadīth which are incontrovertible. Let it be known than, this analysis is not general but particular. However, it will be a novel critique to re-visit this concept. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

İlk dönemlerde umum ifadelerin tanımına, varlığına ve kapsamına dair tartışmalar yer alırken Gazzâlî sonrasında klasik mantığın konularından olan tümeller de tartışmada yerini aldı. Bu makale âmm lafızların gönderimde bulunduğu anlamın tümelliğini sorgulamakta ve klasik sonrası usul düşünürlerinin umum-tümel ilişkisine dair teorik açıklamalarını incelemektedir. Makalenin iddiası şudur: Fıkıh usulünün elfâz bahislerinde ele alınan umum ifadelerin tümellere delâletini savunan ve bunu dilin zihnî suretlere vaz olunmasına bağlayan ilk usulcü Gazzâlî’dir (ö. (...) 505/1111). Fahreddin er-Râzî (ö. 606/1210) ve sonraki dönem usulcüler ise âmm lafızların tümelliğini kabul etmemiş sadece fertleri arasında tümel bir anlamın var olduğunu savunmuştur. Aynı düşünceyi devam ettiren Karâfî (ö. 684/1285), İsfahânî (ö. 688/1289) ve Sübkî (ö. 771/1370), İbn Sînâ’nın (ö. 428/1037) etkisiyle umum ifadeleri tümel önermeler olarak değerlendirirken Teftâzânî (ö. 792/1390) kapsam kavramı üzerinden hem tüm hem tümel olarak görmüştür. Şâfiî, Kur’ân’ın arabîliği görüşünün ilk ve en tavizsiz savunucularından biridir. Kur’ân, muhatapları Arap olduğu için Arapça nazil olmuştur. Şâfiî nazarında Kur’ân’ın arabî olması Arap dilinin kurallarına, üslubuna uygun olmasının ötesinde Arap kültürünü ve düşünce yapısını da barındırması demektir. Dār al-Qurʾāns, which were among the madrasas in the Ottoman period and where qirāʾāt was taught, turned into the Qur'āns schools after the law on unity of education, enacted on March 3, 1924. That was the end of the institutional entity of qirāʾāt education in Turkey. Afterwards, a number of qirāʾāt teachers kept performing this education by their individual efforts. Among these teachers, Osman Nuri Taşkent who was the former head-imam of Nuruosmaniye Mosque in Istanbul was assigned as a (...) Qurʾān teacher in Adapazarı in 1936. This research aiming to address Taskent’s service as a public servant, his educational activities, and his role in the re-institutionalization of the qirāʾāt education is planned as a qualitative case study and carried out by document analysis and interview techniques. In conclusion, this study has demonstrated that (a) this school which aimed to be offered in Adapazarı was planned as qirāʾāt education school, (b) Taşkent was the responsible official teacher (c) 14 students graduated under his mentorship in Adapazarı, and (d) this institution was named as Dār al-Ḥuffāz of Adapazarı in his period. Moreover, it shows that after the leaving of Taşkent, this school maintained the education under the responsibility of Himmet Babalıoğlu who is one of the former students; however, the type of education changed and turned into a general Qur'āns chool.Summary: With the law of unified education which is a turning point in the history of Turkish education, all educational institutions were gathered under responsibility of the Ministry of Education. However, madrasas were closed approximately two months later, even though it was not included in the law. Along with the madrasas, Dār al-Qurrā that are the institutions performing education on the recitation, memorizing, and the principles ofreading the Qurʾān were also attempted to be closed with the similar understanding. However, the President of the Religious Affairs in this period opposed this attempt and these institutions turned into Qurʾān schools due to the insistences of the president that these institutions should maintain their education under the responsibility of the presidency of religious affairs. After this change, qirāʾāt education lost its institutional entity.Whether Dār al-Qurrās have been able to continue education since 1925 as Qurʾān schools is controversial. According to some researchers, the Qurʾān schools after this change were not closed as opposed to other religious institutions, imam hatip schools and Darülfünun Faculty of Theology, and continued their education. Another view is that these courses were officially opened for the first time in 1925, closed since 1929 with the alphabet revolution in 1928, but they restarted education in 1930 with the permission for limited locations in Anatolia and for some teachers in Istanbul. Another view is that the courses planned to be opened in ten places could not be activated due to some obstacles in 1925, but they could be opened after the closing of imam hatip schools after 1930.In some studies, it is stated that the qirāʾāt education, which lost its institutional existence with the conversion of Dār al-Qurrās to the Qurʾān schools, providing general Qurʾān education has been continued with individual efforts of some qirāʾāt teachers such as Serezli Ahmed Şükrü (d. 1932), Hamdi Efendi (d. 1939), Akrepoğlu Osman Nûrî Taşkent (d. 1942), Ömer Aköz (d. 1952), (Ayağıkesik) İsmail Hakkı Bayrı (d. 1972), Hasan Akkus (d. 1972) and Üsküdarlı Ali Efendi (d. 1976). In the same studies, it is also underlined that the science of qirāʾāt regained an institutional entity only after the attempts of Tayyar Altıkulaç in 1968, with the sending of the Diyanet to Aşıkkutlu, honorarily occupied with the science of qirāʾāt in Uğurlu town of Of. However, the fact that Osman Nuri Taşkent was appointed in 1936 as Qurʾān teacher in Adapazarı while he had been the chief-imam of the Istanbul Nuruosmaniye Mosque reveals that the efforts for the institutionalisation of the qirāʾāt education began much earlier.This research aiming to address Taskent’s service as a public servant, his educational activities, and his role in the re-institutionalization of the qirāʾāt education is planned as a qualitative case study. The main problem in the study is whether the appointment of Osman Nuri Taşkent, the chief-imam of the Istanbul Nuruosmaniye Mosque in 1936, as a Qurʾān teacher in Adapazarı is an attempt to establish an institution of qirāʾāt education in the early period of the republic, or not, and the some results are as follows:In the diploma that he awarded Himmet Babalıoğlu who one of his students in Adapazarı, Taşkent presented himself as assigned the teacher and tutor by Turkish Republic for those who want to memorize and learn the Qurʾān as well as to learn qirāʾāt according to books of Shātibiyya and Durra in Adapazarı. This statement shows that his main reason for the leaving Istanbul was qirāʾāt education. Before his appointment to Adapazarı in 1936, Taşkent was giving qirāʾāt education at the Nuruosmaniye Mosque. Accordingly, in his interview with Diyanet Magazine in 1989, Hızal who is one of previous students stated that he had received qirāʾāt education from Taşkent in Nuruosmaniye since the early 1930s. Moreover, in his ratification letter, he stated that Hızal got ratification for Taṣḥīḥ al-Ḥurūf on July 13th, 1933 and qirāʾāt on May 10th, 1935. These statements show that he was occupying with qirāʾāt education in Istanbul. In this case, it is not reasonable to assume that he was appointed in Adapazarı for general Qurʾān teaching.Some documents also clearly reveal that Taşkent went to Adapazarı for qirāʾāt education, and the education he provided there is about qirāʾāt. Six years after Taşkent left Adapazarı, the informative letter which the Adapazarı muftī of the period wrote to the Presidency of Religious Affairs is perhaps the most important document. According to this document, 14 students studied Taṣḥīḥ al-Ḥurūf in Adapazarı graduated under his mentorship. However, it should be immediately stated that “Taṣḥīḥ al-Ḥurūf” in this letter means qirāʾāt education in consideration of that Babalıoğlu and Hızal were among the 14 students. Because Babalıoğlu learned qirāʾāt all of them from Taşkent as in his diploma and Hızal received diploma of Taqrīb. Furthermore, Himmet Babalıoğlu and İsmail Uziş who were the students in Adapazarı submitted their petitions to ask the left position by Taşkent. These petitions are ones of the important documents proving that the process started with Taşkent in Adapazarı was qirāʾāt education. Accordingly, they both addressed their candidacy for Adapazarı Qurʾān teaching by emphasizing their qirāʾāt education and competence in this field.A clear answer may not be given to the question of "Is the appointment of Taşkent as a Qurʾān teacher in Adapazarı individually given to him or is an institution established there?" in the context of his departure. However, some correspondences show that this education was an institutional activity for his period. Then, when it is aimed to identify qirāʾāt education as an institution for its period, the title of “Dār al-Huffāz of Adapazarı” is used and Taşkent is described as “Adapazarı Qurʾān Teacher”. Additionally, as Adapazarı Qurʾān teaching had an institutional quality, one of his students, Himmet Babalıoğlu, was appointed to the relevant position after him. (shrink)

As in the Arab and Persian literatures, many works have been written on the education and teaching of tajwīd, which provides the correct reading of the Qurʼān in Islamic Turkish Literature. Works on this subject were written generally as prose. Besides, some of these works were written in verse style because of practical benefits in education. In this context, the work named Ẓafar written by S̲h̲umnulu Ḥilmī Efendi (d. 1200/1785-86), which is one of the poetical tajwīds that has not been (...) studied enough, is one of the works that can be evaluated under a separate title within religious literaty genres such as forty hadith, ʻaqāʼidnāme and s̲h̲urūt al-ṣalāt (pillars or prayer). This study primarily deals with Ḥilmī Efendi’s tajwīd of verse in Turkish, named Ẓafar, with form and content analysis. The aim of the study is to give information about Ḥilmī Efendi, based on his works and to reveal the text of the work named Ẓafar, which has been transcribed. The importance of the study stems from the fact that it will introduce the first Turkish tajwīd written in verse as far as it has been identified and the master of qırāʼat poet author who can be accepted as the founder of this genre.Summary: During the formation of Islamic sciences such as tafsīr, hadīth, kalām, fiḳh, and ḳırāʼat many works related to these sciences were written in Arabic, Persian, and Kurdish languages. After Turks met with Islam, works were written in verse and prose style to learn the al-Ḳurʼān, the hadīth and the sciences that would help to understand these two sources in order to live a true faith and worship life. On the other hand, as a result of the writing of verse works, some literary genres emerged in Turkish Islamic literature. This issue has also been appeared in the science of tajwīd, which is defined as “a set of rules for the correct pronunciation of the letters with all their qualities” and which ensures the Ḳurʼān to be read properly. As a matter of fact, the writing of both prose and verse tajwīd works defined as a religious-literary genre is an indication of this phenomenon. For instance, Tuḥfe-i Şerīfī (S̲h̲erīfī d. 1260/1844) and Naẓmuʼl-Ehem (S̲h̲eyhī d. 1235/1819-20) are examples of verse tajwīd works. In this context, one of the verse tajwīds is Ẓafar, which is defined by his own writer, S̲h̲umnulu Ḥilmī Efendi, as the first work written in this type.The author of the work, Ḥilmī Efendi, lived in Vardar Yenicesi (Giannitsa) for a long time and died in Hijāz in 1200 (1785-86), is one of the 18th century authors and an specialist in the field. In the work named Osmanli Müellifleri (Bursalı Meḥmed Ṭāhir, 1333 / Ottoman Authors) it is stated that he has works named Manẓūm Tajwīd (Ẓafar) and Manẓūm S̲h̲urūt-ı ṣalāt (Naẓm-ı nefīs) and that he wrote death dates with poetry on the gravestones of the grandchildren of G̲h̲āzī Evrenos Bey (d. 820/1417) and an Arabic khatim prayer. Information about Ḥilmī Efendi's personality, educational life, and scientific level could not be found. One of the works of Ḥilmī Efendi is Naẓm-ı nefīs, which was written in 1190/1776-77, and is in the form of S̲h̲urūt-ı ṣalāt. In this work of 125 couplets except for the title of “Tertīb-i Secāvend-i Ḥurūf” (fāʻilātün fāʻilātün fāʻilün) the author used the meter of the fāʻilātün fāʻilātün fāʻilātün fāʻilün and preferred the masnavī as a form of verse. The work consists of a introduction of 9 couplets, a main part of 24 couplets, an addition and conclusion of 3 couplets.Another work of Ḥilmī Efendi is the work called Ẓafar in the form of verse tajwīd, which he wrote on the request of some of his friends and which is the main subject of this study. There is no record of the writing date of this work. This study also includes the transcribed text of the work. However, when considering the period the author lived in and the time of his other work Naẓm-ı nefīs (1190/1776-77) it is estimated that Ẓafar was written after the second half of the 18th century. However no manuscript copy of Ẓafar could be found. Therefore, for the text to be transcribed in this study, the oldest dated and printed copy with Arabic diacritics of the work (Istanbul: Dār at-tıbāʻa al-āmire, 1265) was taken as basis. In this copy, the work was incorrectly named as Tajwīd-i Manẓūm. Also, there are some typographical errors in the headlines or text; these errors were tried to be corrected. It consists of 71 couplets; an introduction and 25 main titles. Ẓafar, written was written in half, full and rich rhyme. In some places, as well as rhyme, redif (repeated voice) created with an appendix or a word was used. The work has a clear, intriguing and narrative language and expression.Traditionally, the author starts his work by praising God, salawat, prayer, followed by a statement about the importance and the provisions of the learning tajwīd. Then the author gives informations about some tajwīd subjects such as ḥarf-i med, sebeb-i med, medd-i muttaṣıl, medd-i munfaṣıl, and so forth.The author bases on the Ḥafṣ narration of the ḳırāʼat of the ʻĀṣım probably because of taking into account the readers. Another point that draws attention in the work is that the tajwīd issues are explained shorter and clearer compared to other verse tajwīds. There are also no secondary topics such as ţūl, tevaṣṣut, ḳaṣr, ḥarf-i muḫaffefe, kelime-i müṡaḳḳale or istiʻāẕe-basmala, states of tā-i teʼnīṡ. To provide an easy memoration Ḥilmī Efendi does not apply the method of formulations of letters corresponding to the bases such as ikhfā, iẓhār as in many other tajwīd Works. Instead, he writes the letters of a specific rule one by one. Additionally, he does not give many examples from Qurʾān verses to consolidate the rules, and sometimes refers only to the surahs. With his work called Ẓafar, the author follows and represents the tradition of religious-literary works in general, and in particular, the tradition of the verse tajwīd. In some verse types of tajwīd works, for example, only subjects of ḳatʻ and vaṣl are discussed, however, in Ẓafar, most rules of tajwīd are included.It can also be said that the work has a special place and importance due to the possibility of being the first text (constituent text) written in verse tajwīd. On the other hand, when considering the conditions of the period and the fact that it was published more than once, it can be stated that Ẓafar was used as a material in educational activities and raised attention. Kur’ân-ı Kerîm kelimelerinin yazım özelliklerini inceleyen ilim dalına resm-i mushaf /resm-i Osmânî adı verilmektedir. Bu ilme, Hz. Osman’ın (ö. 35/656) halifelik devrinde (644-656), dönemin fasih Arapça kaidelerine göre yazım esas alınmak sûretiyle gerçekleştirilen mushaf istinsah faaliyeti kaynaklık etmektedir. Sahabe eliyle gerçekleştirilen bu çalışmada kullanılan imlanın, sonraki dönemlerde yazılan mushaflarda esas alındığı kabul edilmektedir. Bugün Hz. Osman himayesinde imla edildiği kesin olarak bilinen bir mushaf mevcut değildir. Bu yüzden Hz. Osman mushaflarındaki yazım şekillerine ait detaylar ancak hicrî 3-4. (...) asırlarda telif edilmeye başlanan eserlerden öğrenilebilmekte, resm-i mushaf kriterleri mezkûr kaynaklar baz alınarak belirlenmektedir. Lakin mushaf istinsahı faaliyetinden 3 asırdan daha fazla bir süre sonra kaleme alınan eserlerde verilen bilgilerin yeterliliği/sıhhati konusunda birtakım tereddütlerin varlığı malumdur. Mezkûr tereddütlerin izale edilmesine katkı sunma maksadıyla hazırlanan bu makalede, alanın temel eserlerinde yer alan resm-i Osmânî kaideleri bağlamında Topkapı Sarayı Müzesi/Emanetler Hazinesi 2 nr. Mushaf incelenmektedir. Erken dönemlere ait olduğunda şüphe bulunmayan Mushaf’ın, Hz. Ali’ye (ö. 40/661) tarafından yazıldığı iddia edilmektedir. Mevcut çalışma sayısı bakımından oldukça yeni bir alanda yapılan bu araştırmada, hicretten birkaç asır sonra telif edilen eserler vasıtasıyla ulaşılabilen kaideler ile erken dönemlerde yazılmış TMSK E. H. 2 nr. Mushaf’ın imlası kıyaslanmak sûretiyle, kaidelerin o dönemde ne derece uygulandığını tespite çalışılmıştır. İki bölümden müteşekkil makalenin ilk kısmında, Mushaf’a dair tanıtıcı ve teknik mahiyetteki bilgilere yer verilmiş, Mushaf’ın Hz. Ali’ye nispeti tetkik edilmiştir. Mushaf’ın erken dönemde imla edildiği ancak Hz. Ali tarafından yazılmasının mümkün olmadığı kanaatine yer verilmiştir. İkinci kısımda, ilgili eserlerde “hazf, ispat, ibdal, maktu‘/mevsûl yazım, hemze, Mesâhif-i Emsâr’ın gönderildiği beldelere göre farklılık arz eden yazım farklılıkları” şeklindeki konu başlıkları altında yer verilen toplam 1406 kelimenin yazım özelliğiyle TMSK E.H. 2 nr. Mushaf’ın yazımı mukayese edilmiştir. Sayfa, âyet noksanlığı bakımından neredeyse kusursuz nitelikteki bu Mushaf’ın tamamında yapılan inceleme sonucunda toplam 319 kelimede kaidelere muhalif yazım olduğu tespit edilmiştir. Üzerine inceleme yapılan tüm kadim Mushaflarda da görülen bu imla uyumsuzluğu, resm-i mushaf kaidelerinin sıhhatine dair mevcut soru işaretlerini kuvvetlendirmektedir. Bu da resm-i mushaf ilminin sınırlarını tespit için kadim mushafların imlasının da dikkate alınması gerektiğine, bunun için de erken dönemde yazılmış mushafların yazım şekilleri üzerine daha fazla araştırma yapmanın gerekliliğine işaret olarak kabul edilmelidir. This article examines the influence of the Hanafī philosophy of the Mamlūk period on the early Ottoman fiqh studies. Since the Egyptian and Damascus regions, which were under the rule of the Mamlūks, became the most important centres of knowledge in the Islamic world, it is understood that the Mamlūks’ scientific knowledge was superior to the Ottomans. On this occasion, many scholars who were considered the leading figures of the Ottoman scientific community turned to Egypt and Damascus regions and benefited (...) from the scientific accumulation there. In fact, these scholars who played an active role in the formation of the Ottoman scientific environment completed their education in Damascus and Egypt under the rule of the Mamlūks and graduated from the Mamlūk education system and assumed important roles in the formation of the Ottoman science understanding. During this period, the Hanafī judges (fuqahāʾ), who were active in the Mamlūk community, contributed to the development of the leading names of the Ottoman scientific community and this thought had an impact on their understanding of science. In this context, it is possible to say that the fiqh studies of the Ottomans in the first period were influenced by the Mamlūk Hanafī who had their characteristics. The two main characteristics of Hanafī thought in the Mamlūk period, the hadīth-centred juristic (fiqh) idea and the method of mamzûc (mixed) fiqh style are also seen in Ottoman fiqh works.Summary: In this article, the effect of Hanafī fiqh thought on the early Ottoman fiqh studies in Mamlūk period is discussed. While the Ottomans did not yet establish a scientific tradition in the period of foundation and ascension, many Mamlūk cities replaced Baghdad as the centre of knowledge of the Islamic world. Because the Mongol invasion, the crusades and the destruction of Andalusia due to reasons such as many scholars displaced by the Mamlūks settled there. Especially during this period, Egypt and Damascus, which were under the rule of the Mamlūks, became the most important centres of science in the Islamic world. In this respect, 14th-16th It is accepted that the science level of the Mamlūks was quite superior to the Ottomans in the 16th century. On this occasion, many scholars who are considered as the leading names of the Ottoman scientific community turned to Egypt and Damascus regions and benefited from the scientific accumulation there. Osman Ghāzī’s teacher and father-in-law, Sheikh Edebālī, Davud-i Kayserī, Sheikh Bedreddin, Molla Fanārī, Molla Gürānī are some of these scholars. In addition to these, scholars such as Muhsin-i Kayserī, Germiyanlı Poet Ahmedī, Hacı Paşa, Celāleddin Hızır, İbnü’l-Cezerī and İbn Arabşāh have also studied science in Egypt and Damascus. These scholars, who played an active role in the formation of the Ottoman scientific environment, completed their education in Damascus and Egypt under the rule of the Mamlūk and after graduating from the Mamlūk education system, they played an important role in the formation of the Ottoman science understanding. Sheikh Edebālī was accepted as one of the scientific and spiritual leaders of the Ottoman Empire. Davud-ı Kayserī was the first chief professor of İznik madrasah, the first Ottoman madrasah. Molla Fanārī had the privilege of being the first Ottoman shaykh al-Islām. Molla Gürānī became the teacher of Fatih Sultan Mehmed. During this period, the Hanafi faculties, which were active in the Mamlūk science community, contributed to the growth of the leading names in the Ottoman science community. Molla Fanārī, Seyyid Şerif Cürcānī, Shaykh Bedreddin and Poet Ahmadī have learned lessons from Bābertī, who important Hanafī scholars in Egypt. The idea of Hanafī fiqh in the Mamlūk period influenced the studies of the Ottoman fiqh in the first period. In this context, Molla Khüsrev refers to Zeyla‛ī and Bābertī, the leading Hanafī scholars of Mamlūk in many parts of his work, although he did not go to the regions dominated by the Mamlūks. The two main characteristics of the Hanafī thought in the Mamlūk period were the hadith-centred fiqh thought and mamzûc (mixed) method of fiqh. In the Mamlūk period, hadith studies which were not seen before in Hanafī sect were done. During this period, Hanafī jurists spent time in the field of hadith such as Ibn Balabān, Ibn Turkmānī, Zeylaʻī, Kuraşī, Mogoltay b. Kılıç, Bedruddīn Aynī, Ibn Kutluboğa, Serūcī, Bābertī, İbnü’l-Humām, İbnü’l-‛Adīm. They tried to eliminate the lack of studies in the field of hadith in the Hanafī circles while their studies certainly require hadith expertise. As a result of the works of these jurists in the field of hadith, the basic sources were frequently included in the fiqh studies in the Mamlūk period and, the hadiths were started to be made. The influence of this understanding, which had an important place in the thought of the fiqh of Hanafī during the Mamlūk period, can be seen in the Ottoman fiqh works in the first period. In this context, Molla Khüsrev, in his work with the influence of the early Ottoman jurists who had been educated in Egypt before him, gave some basic sources of hadith and sometimes gave information about the reliability of hadiths. On the other hand, it is possible to say that this issue is quite insufficient in Ottoman fiqh works when compared with Hanafi jurists of the Mamlūks. A comparison of Ibnü’l-Humām’s Fethü’l-kadīr and Netāicu’l-efkār, which was performed by Kādızāde order to complete it, can be compared. Apart from that, there are different attitudes between Şürünbülālī and Şeykhi-zāde known as Damad Efendi, they lived in the same period. Şürünbülālī, one of the Egyptian scholars of the Ottoman period generally gave the hadiths from the basic hadith sources in his work Merāki’l-felāh, while Şeyhīzāde did not obey this issue and rarely included basic hadith sources in his work Mecma‛ü’l-enhur. These differences can be explained by the necessity of the scientific environment. Because the Hanafīs were accused of not using hadith in Egypt and its environs, the Hanafī jurists living in this region should have directed them to be more rigorous about the hadith. However, since the Hanafī jurists living in other Ottoman regions did not have such a problem, they probably did not feel the need to refer to the main sources of hadith in the power of hadiths. Therefore, it can be said that the scientific environment and the need arising in this direction lead to different attitudes of the jurists living in the same period. The mamzûc (mixed) method starting with Ibnu’s-Sāātī, In the 8th-century, it was especially effective on the idea of ​​the fiqh style of Hanafī jurists. Although the first name of the mamzûc (mixed) method, Ibnu’s-Sāātī, was not one of the scholars of the Mamlūk period, the influence he initiated was more common in the Mamlūk period and became one of the characteristic features of the Hanafī fiqh thought in this period. Therefore, it is understood that the majority of Hanafī jurists had a gratified method. In addition to this, it is seen that Ottoman jurists who were educated in and around Egypt write procedural works in grammatical style. Molla Fanārī's work Fusūlü’l-Bedāyi is the most important example of this genre. Moreover, even Molla Khüsrev, who had not gone to Egypt and his surroundings, wrote a memoir-like work called Mir’ātü’l-Usûl. The works of these two authors show that the Ottoman jurists were influenced by the Mamlūks. As a result, it is possible to say that the fiqh studies in the early period of the Ottomans were influenced by the Mamlūk Hanafīs who had their characteristics. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert (...) bir ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. Tartışma Osman ed-Dârimî (ö. 280/894) ile Bişr el-Merîsî’nin (ö. 218/833) taraftarları arasında geçmektedir. Hadisler üzerinde Ehl-i hadîs ile Ehl-i re’y mensubu âlimler arasında gerçekleşen bu tartışmalar bir yönüyle hadislerin anlaşılması ve yorumlanmasını ilgilendirmektedir. Tartışmanın, burada ele alınan hadislerin nasıl anlaşılması gerektiği; lafızların kelime anlamı mı (literal) yoksa bu lafızların ötesindeki muhtemel mecazî anlamları dikkate alınarak mı anlaşılması gerektiği noktasında odaklandığı söylenebilir. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Hakikatin ortaya çıkarılmasında rivayet re’ye, re’y de rivayete muhtaçtır. Rivayet ve re’y birbirinin rakibi değil tamamlayıcı unsurları olarak görmek gerekir. (shrink)

Open peer commentary on the article “Religion: A Radical-Constructivist Perspective” by Andreas Quale. Upshot: Quale offers a way of categorizing religious discourse based on radical constructivism. This commentary raises questions about the inter-relation of cognitive and non-cognitive knowledge, the role of testimony in learning about religion, and whether knowledge and belief have different roles in cognitive and non-cognitive knowledge, and suggests that Quale’s analysis opens a tolerant perspective on religious discourse.
